You make the question hypothetical by using 'absolute' arguments. By excluding the possibility of innocence (in life), you force the whole reasoning into the direction you want it to go.
If a hypothetical question is only open to speculation, it is more depending on the person asked to answer it than on the question itself. I must admit you dodged this question artfully.
