I have a question. many adult film stars have children (some under 2 years old). Should they be afraid of Child Protective Services coming after them for doing scenes? I always wondered about that. Is there a legal precedent?
Generally, I don't think this would trigger any sort of CPS investigation unless the child was being exposed to sexual activity. One example might be bringing the child to a porn set.
However, I could easily see some fathers attempting to make an issue of the mother's work in a high conflict custody dispute under the more general "best interests of the child" standard. Typically, the father will assert they do not want their child raised in that sort of unwholesome environment. Father will try to paint a picture that he has superior values, goes to church and can provide the child with a proper upbringing unlike Mom, the wicked and immoral porn slut. Of course, mediators and judges will often take into account Dad was well aware what Mom did for a living before the child was born. In many cases, that takes a lot of wind out of Dad's sails. Other trappings of being a porn star could affect custody issues as well such as drug and alcohol abuse.
These type of issues also arise in family law court with other sex workers such as erotic dancers.

Any whore who does preggo scenes should have her child taken away from her at birth.
Just my unwanted or unasked for opinion.

Interestingly this was posted for me.... I went through this with Tiffani in NM. At first the Judge was all not too happy with a pornstar fighting for custody, however, after several appearances, the Judge realized that porn doesnt necessarily mean bad mother. She later turned against the ex and basically supported Tiffani despite her career choice. Less important than the career is the stability of the mother. Porn alone should not make a difference. Drug use, alcoholism, lack of a stable home environment all are more important than the career path chosen in my opinion. Each case will be different though. Michael www.adultbizlaw.com

And that response just goes to show why they call it "practicing" law.
Now that the pornlawyer has shared his opinion the rest of us should be able to chime in. It comes down to common sense and whether or not the child is being directly exposed to this morally bankrupt behaviour.
So Christian...if some whore said she wouldn't fuck you because she was afraid of losing her child, it's more likely she just doesn't want to take on all the risks of your "advanced sexuality" and she didn't want to hurt your feelings.

I have dealt with this firsthand. Canadian dealign with an american divorce. Unless the children are being exposed to a unacceptable (by case worker regard) environment...your fine.
however as far as divorce proceedings go, any adult happenings are a character liability.

i already the answer to the custody question Michael. My question is more about the question of an infant (like a child under the age of 2). can CPS step in or is that out of their jurisdiction?
CPS can step into a situation involving a child for basically any reason. They are there to protect children. The final arbitrator will be a judge though. The hearing as to custody will eventually find its way before a judge and he/she will make the call.
CPS can be overly zealous with their decisions at times.

I wouldn't say CPS can step in "for any reason." Child Protective Services investigates allegations of abuse and neglect that may put the child at risk. California law defines child abuse as follows:
• A child is physically injured by other than accidental means. • A child is subjected to willful cruelty or unjustifiable punishment. • A child is abused or exploited sexually. • A child is neglected by a parent or caretaker who fails to provide adequate food, clothing, shelter, medical care or supervision.
I do agree they can be over zealous at times and also their investigations are cloaked in secrecy.

See Veronica Hart's case. And be careful with the word "precedent."

I wondered what good sending a child to a foster home or something comparable would do, for they probably have facilities, staff, time and funding in abundance.
And friendly roommates.
