"The 4-year-old child is in extremely grave condition. We don’t even know if the child is going to make it. Doctors are very skeptical on that. They’re doing everything they can, but it does not look good for the 4-year-old," Capt. Ronald Marbrey of the LAPD. The child’s 2½-month-old sibling and 31-year-old mother, all natives of India, were also hospitalized Tuesday, KNBC’s Robert Kovacik reported. The crash, which was originally blamed on street racing, occurred at 3:12 p.m. at 17119 W. Sherman Way, between Balboa Boulevard and Louise Avenue, at 3:12 p.m. Tuesday, said Ron Myers of the Los Angeles Fire Department. "Witnesses tell us that two individuals were driving at a high rate of speed westbound, here, on Sherman Way. It appeared to witnesses that they were jockeying for position," Marbrey said. Marbrey said witnesses said the vehicles were traveling between 50 mph and 90 mph. "They were cutting each other off," Marbrey said. "At one point further down the roadway, the red Camaro slammed on his brakes and the black Nissan barely missed colliding with him." "Further down the road, here at Amestoy (Avenue), the red Camaro applied the brakes hard, the black Nissan attempted to avoid a collision and swerved to the right, and collided with a silver Daewoo," Marbrey said. Marbrey said that the Daewoo slammed into the family, pinning them against a black Honda Civic. Marbrey said the mother will probably lose one leg. Marbrey said her other leg was also severely crushed. The infant suffered severe scrapes and injuries, according to Marbrey. "That child, according to witnesses, was launched into the air and slammed against a tree. This is the tragedy of this incident, and this will impact this family. The father is totally distraught. He’s overwhelmed by this incident. It’ll impact this family for years and years to come," Marbrey said. Police said the driver of the Nissan, 19-year-old Armando Ayon, of Pacoima, and the driver of the Camaro, 44-year-old Brian Barnes, of Northridge, have been arrested and charged with attempted murder. If the 4-year-old dies, the pair would be charged with murder, Kovacik reported. "This incident did not have to happen. That’s the tragedy of it," Marbrey said. The crash occurred one day after a street race that resulted in a fiery crash that killed a woman and her two children in El Monte. Luke says: Brian Gilbert Barnes was born June 1, 1963. How can they be charged with attempted murder? I'm no porn-message-board-fake-lawyer or anything, but doesn't murder have to be premeditated and have a motive? Wouldn't this be involuntary vehicular manslaughter or something like that?

This must be one of those reactionary "get tough on _____" laws passed EVERYWHERE recently. I remember that if a child killed another child he/she was rarely tried as and adult. Now it’s as common as herpes in XPT moderators. I guess it should be vehicular manslaughter. Evidently local citizens and law makers have decided that if a person is willfully engaging in an activity as inherently reckless as street racing then they are premeditating killing somebody when an accident happens.
He deserves what ever he gets. Those people he hurt certainly didn't deserve what they are suffering though.

Perhaps Mr. Fattorosi esq. can illuminate us (except that he's also Brian's lawyer), but I believe that if someone dies whilst you are committing a felony it increases the charge from manslaughter to murder.
Assuming that street racing is a felony, then that's what you got.
Same shit if you accidentally kill the person you're kidnapping.

isnt it california law that a child should use a car seat or booster seat until the age of 6 or weighs more than 60 lbs??? if the child was properly secured inside the car, then i find it strange that the child was ejected from the car and hit a tree.
if the child was not in a car seat, then i find it negligent on behalf of the mother.

i just watched the interview on knbc.com. the mother was getting out of her car, while holding her infant child, and had the 4 year old next to her. when you have access from a car onto a sidewalk or non traffic area, why dont you exit that way? why in the hell would you get your young children out of the drivers side of the car and put them into possible oncoming traffic? STUPID STUPID STUPID!!

the family was behind their car near the trunk unloading groceries. they were crushed when the 19 year old driver's car swerved to avoid surewood and hit the car parked behind theirs and squashed them between the two parked cars.

Actually, VJ, it's preetty clear. CC 187 says murder is the unlawful killing of another human with malice aforethought. CC 188 says malice can be implied, "When no considerable provocation appears." Vehicles are considered "destructive devices." So if you're road-raging with another guy, you're already committing one crime. If you kill somebody while commiting another crime, you've committed first degree murder.

true. i just find it crazy! a friend of mine was in a similar type accident; the four passengers she was carrying ended up dead as a result of the accident (all under the age of 18). she was charged with vehicular homicide and served no jail time.

I doubt your friend was committing a felony while she was driving. A client of mine once got drunk at his company's Christmas party, crossed the center line and killed his girlfriend plus two other people in another car. DUI is a felony...he was convicted on 3 counts of murder. Case.

Fat Willie is mostly correct on the murder standard. The standard is malice aforethought. In layman terms, that means he was intentionally doing something he knew was bad and could lead to people getting hurt and which caused a death. The papers indicate he is being changed with felony murder. Felony Murder can be extremely far reaching. The text book example is a police officer speeding to stop a robbery who gets killed in a vehicular accident. The guy who committed the robbery (felony) will be convicted of murder.
Page one in the prosecutors handbook says you make the top count on a charge that's a little bit of a stretch. If the prox is seeking Murder two, then theres a good chance that a deal can be cut for a lesser count. If Brian has no criminal past--a big if for an adult performer--then the jail time could be reasonable under the circumstances. My money would be on three 2-3.
I don't think his being an adult performer had anything to do with the murder charge. I think it was due to Brian being a white guy and the victim being a minority. Luckily the family wasn't black or you'd have a potential Sharpton situation with advocates calling for his head. Right now the goal should be to get Brian out on bail and hope things cool down and the prox is willing to take an easy plea instead of a trial.
I see a haircut, a shave and a dark suit in Brian's immediate future.

I just read the thread about this at adt and someone pointed out that this would be his "third strike". I wonder what his other two strikes are? And if they tested him for drugs then he is really fucked. He was probably high at the time, given that everyone says he is a massive pothead.

I just wanted to jump in for a minute since I have not posted to this thread at all. Obviously, I have been extremely busy. However, I cannot comment on Brian's situation other than to say we have continued the arraignment/bail hearing until next Wednesday, Oct 17th. We are in the process of interviewing experienced criminal defense attorneys with a background in vehicular homicide cases as well high profile cases. We are also looking into accident reconstruction experts and investigators. As for Brian, he's hanging in there but obviously this is not an easy situation on any of the families involved, especially the the Arif family. Brian's aunt gave a statement yesterday sending Brian's, his family and his friends thoughts and prayers to the Arif family in their time of mourning. Thanks Michael www.adultbizlaw.com

Not at all. He chose his words carefully and didn't say much beyond the fact that they were looking for a criminal defense attorney and experts to testify on Brian's behalf. Plus prayers for the family. Exactly what needed to be said and not a word more.

As for Brian's actual criminal trial representation, I have already talked to the family and have permission to interview four attorneys. All four have experience with high profile cases and are well know by the criminal bench. I will not name the attorneys until after having a chance to speak with them directly in order to determine their interest in the case as well as their fee structure. Funds are limited so that will be a factor as to who can be retained to defend Brian. I am hopeful that those who support Brian emotionally will also help financially. You know I just remembered, I almost ran Brian Over in the lobby during the AVN awards in 2006. Quick update .... I was able to speak with six attorneys in regards to being associated in on Brian's case. I was able to narrow the search to three criminal defense attorneys, with all three having handled at least six vehicular homicide cases. All three are equally up to the task and have the necessary experience. Brian's family has also spoken directly to all three. The family is at a point of weighing the costs involved with taking this matter to trial and will decide tomorrow on who they will retain. If you are interested in attending and supporting Brian, the hearing is scheduled for Wednesday October 17th, 8:30am at the Van Nuys Sup. Ct Depart. 100. Fattorosi was on this past Wednesday afternoon. After casually suggesting an image change in which I, as Fattorosi's potential image consultant, would have him adopting more of a General Custer look by wearing attorney Jerry Spence's old fringe buckskin jackets, Fattorosi said lawyers tend to have their own style and look. "I'll tell you what Brian Surewood's mom said when she met me," Fattorosi continued. "She goes yes I can imagine you being Brian's attorney." Fattorosi felt that had he walked into that first meeting with a pinstripe demeanor she would have looked at him, "How could you be his lawyer?" "By putting that bail up, your price of freedom is $125,000. That's what you're going to have to pay and you're not going to get that money back to be able to walk free. Not a lot of people have $125,000 sitting around to say, hey, I want to be free. Especially when you're looking at a criminal case the way we're looking at it. You've got to conserve resources and spend the money where it's best spent." According to Fattorosi, a preliminary hearing is scheduled some time in January, so Surewood remains in custody until then. I asked Fattorosi what Surewood's day would be like. "He can receive letters, he can receive care pacakages," continues Fattorosi. "But as far as interaction with other people, no." Which means no TV. "You can't do shit and just stare at a wall," I add. "Read and stare at a wall," Fattorosi agrees. "Jail's not a fun place to be for any situation. But when you're in protective custody that makes it much more difficult." Another attorney was brought into the case. "I'm not a criminal defense attorney handliong criminal; cases of this magnitude," Fattorosi explains. "For a thing like this, I wanted an attorney involved in the case that knew the Van Nuys court house, knew the judges, knew the prosecutor and we actually went through a fairly long list of attorneys that were capable of handling this case. "With his family and his friends input, we selected a firm by the name of Jonathan Kissel. The actual attorney that's going to be handling the case over there is a man by the name of Peter Korn who was a prosecutor in the Van Nuys office for 14 years." "He knows prosecuor Falco who is handling the case on behalf of the county of Los Angeles," states Fattorosi. "I know that Brian's in very capable hands with Kissel and Korn doing the vast majority of the criminal defense work. I'll sit second chair; I'll help out where I can but they're going to be doing the vast majority." I thought that the LA mayor's comments about throwing the book at Surewood were a little disturbing. "What would you expect him to say?" comments Fattorosi. "Honestly, as a politician there was a lot of uproar over this case. I remind anybody who's watching or listening, the day before this happened there was another incident in El Monte where you had to road racers, allegedly, who ended up killing a mother and two children. Their car flipped over and burst into flames. So when you have that back-to-back, you got to have the mayor step up and say something. I don't blame the mayor for what he says. He's a politician and he's going to do what he can to stay on the voters good side." "What I don't like is what LAPD is doing," Fattorosi adds. "Those are police officers not politicians. Some of the quotes they've made, while not being inaccurate, are sensational. And to go out there and make sensational quotes about an ongoing criminal investigation makes me a little concerned."
