It's true...in some cases, the literature will go so far as to say "Actual Photo of Entertainer"....of course it doesnt mean the entertainer actually works for them, but hey, when you dick is hard, your 200 bucks is burning a hole in your pocket and the girl (hopefully) is standing right in front of you, chances are you will park your penis in her mouth for a 8 minute express blowjob...

Correct Holly, very astute of you to conclude this...it is exactly the type of marketing/bullshit techniques used by most "Impulse Buying" Industries and Businesses. Use a "FANTASTIC LOOKING" picture, image or display that casts your product or service in overly positive light to increase the chance the customer in a moment of vulnerability impulsively buys whatever it is you are selling...

PORN, and sex in general, are almost exclusively Impulse driven in terms of purchasing decision making goes....Look at the Websites of Porn Companies and the Box/Dvd Covers (including....*gasp shock* Suze Randall Brand stuff) ... It stands to reason that Escort Companies would practice the same thing.

I think you're CLEARLY right that the copyright holders have the best claim but I was going on Michael's statement:

I'm not an attorney but I would think that Michael's issue may not be over the picture per se but the implication that his client, a known celeb, would attend. Maybe using her "celebrity" to gain profit without her benefit - as opposed the use of a photo to which she has likely has signed away rights.

Or, maybe some of these girls have rights to the photos and I should just shut my fucking trap.

This is only true if the picture was purchased by the party using it. Otherwise, there is a copyright infringement claim as well as a misappropriation of likeness claim.

A quick lesson is that both the photographer and model have claims. The photographer in federal court, IF, they have registered and copyrighted their photo with the copyright office. Mostly likely most photographer's dont do this with every photo. Thus I would rather represent the model on a common law right in state court. Better juries, higher awards/judgements.

The better and easier claim(s) is a misappropriation of likeness/right to publicity for the model. You cant just use someone's image to advertise your goods or services without compensating the model. Its really a slam dunk situation.
