I guess the lack of response from EA's press person means that the fund is going to be for EA first, and then if there is any money left <snicker>, it will go to others. I kind of feel OK with this because it was their idea, but then at the same time I keep wondering why Max wouldn't get his fair share of the fund?

Can someone explain how this fund is for the entire industry since there are 3-4 larger battles already raging, and at least 40 smaller ones. I guess that the mom and pop adult DVD store that has been open 20 years and that makes 1/100th of what John does a year should be excluded too. Aren't a lot of those guys your customers Evil Angel? Isn't any fight in porn worth fighting?

Next, I wonder why, if they are truly so caring for the creation of a porn legal fund, why they wouldn't put their millions into it?

Ahhh, but perhaps they are? Would it not make sense for John to "donate" hundreds of thousands of dollars at a time into this fund, creating a tax deductable shelter for his legal bills? It's brilliant really. Of course what would throw a monkey wrench in here is if someone like Max or one of these small video stores or strip clubs started trying to suck money out of it. All the tax benefits would disappear. That said, until this case is over, they need to either:

A) Make sure the fund only gives money to EA by putting a puppet on the fund distribution that would deny everyone but EA.

B) Put each companies money asside, and offer to allow Max, etc to use a private portion of the fund for his own tax deductable legal bills.

I see this more of a tax write off, lowering the total legal burden. So Max, if you are reading this, you should contact the fund administration and see about the possibility of donating money into the fund that would be "pre-approved" for use on your case. If you spend another $200k, this could be a pretty nice write off for you.
