To All,
I do not frequent these boards, so I just recently became aware of this slanderous/libelous gossip. I will not go into great depth on advise of counsel now that there is pending legal action. I will however answer the only question out there that deserves addressing. Jessica and I have not now, nor anytime after the knowledge of her contracting HIV, had sex of any kind, nor exchanged bodily fluids in any manner, and my long (1&1/2 years) track record of clean tests proves that. Anyone who starts or continues to spread falsehoods will find themselves sitting in a court room. End of Story.

Now that everyone has chosen to blow this gossip way out of proportion, I will respond to the one question that is even worth answering. Since finding out I was HIV positive Shane and I have not exchanged bodily fluids in any manner, and Shane's long track record of negative tests proves that. Shane has been a friend to me when I needed help and could not find it elsewhere. For all of you to point fingers with no knowledge whatsoever shows you for who you really are.

It's pretty obvious that smartt, second smartt, william calhoun and degenerate are all the same moron. I only put the offending one in the penalty box.
Let's review some facts:
1. Shane does not have AIDS
2. Shane might loosely fit the legal definition of a public figure.
3. It seems to me putting that picture up immediately after the person in question comes into a place he's never been before (and starts making references to public proceedings, counsel etc) could be considered defamatory. This could be libelous.
Whatever you think of the Shane/Jessica thing, that last thing needed is someone inciting him to carry through on his legal threats. If someone else with the Wonder Twin Powers wants to let him back on the ice, fine. But smartt is an uncreative poster who gets off on his own pusillanimy.
And trust me, I recognize the glaring irony that I booted someone in this thread just one week after getting myself banned from ADT over the same topic.

Smartt may be suspended for a few days - Tony or Jeff will decide Monday if even that is warranted. There is precedent for this - Smelly Monkey was banned for a week or so last year for the same kind of thing with Chico.
Am I the only person who doesn't think that Shane or Jessica wrote those notes? Those were both written by the same hand, and I doubt that with with their rather different backgrounds that black American Shane and Czech Jessica happen to have the same writing styles and vocabulary.
PS. It is important that mods not get too comfortable with the Ban button as the first choice for dealing with something they don't like. That's the Steph-syndrome: all that does not meet the personal pleasure of the Alpha Female is banned. A little persuasion can be used too: a PM request to stop is often all it takes.

Hey guys, let me (and the mods) worry about Smartt and the stupid shit that comes out of his mouth. You guys should be more concerned about the matter at hand- Shane and Jessica's posts.
And IMHO, his response is overdue and most likely only made because he's losing work; not because he's concerned about his fellow talent.
Whether or not the allegations that he and Jessica were dating is true, the fact remains that they were still alledged and these allegations were serious enough to warrant A TIMELY RESPONSE. Dealing with the allegedly libelous nature of the initial post, or responses from porn fans, is not as important as the underlying assertion that he has been putting people's lives at risk.

Unlike the legal system in Brazil where the Witch Doctor reads the burnt entrails of a goat in a trance induced by a hallucinogen, in order to discern the righteous party in a dispute. We have laws written in books. Contained within these laws is something called a disclaimer. For an example please read the one posted just before entering the Monkey Cage. Shane can still sue but because of this disclaimer I would seriously doubt a jury would vote his way or that a lawyer would even try to bring the case before one.
On the other hand if he decided to sue smartt and did win, what would he really get? A Sao Paulo hovel, with a complete morticians setup in the basement, a butt load of pirate DVD-R’s, about 300 polished skulls of street children, and enough tranny porn to make even Joey Silvera green with envy. Not exactly worth the effort is it?
