A four-woman, two-man Lincoln Parish jury took three hours and 33 minutes to return a guilty verdict against accused obscenity dealer Dan Sasha Birman Wednesday.
Seated at the defense table, an apparently shocked Birman laid his head on his hands as a buzz of whispered conversation swept the courtroom when Deputy Clerk Caroline Hunter read the verdict.
Birman was indicted in June of selling obscene materials to undercover state troopers. The case attracted immediate regional news coverage as prosecution and defense attorneys argued over First Amendment rights and other evidentiary issues.
Third Judicial District Judge R. Wayne Smith after the verdict immediately remanded Birman to the custody of the Lincoln Parish Detention Center until sentencing, but a defense request for bond was agreed to by 3rd Judicial District Attorney Bob Levy.
“Since the offense carries a prison term up to three years bond is set at $25,000,” Smith said, “and there will be a special condition imposed — any criminal activity will revoke the bond and that means obscenity.”
The court could also impose a $2,500 fine, Levy said.

If I remember right, Hustler Barely Legal 16 was the title he sold. No, I haven't seen any of that series, it seemed too soft for me. But if selling that title can possibly get that guy a 3 year prison term. How can anyone criticize ADE for not shipping to the south? Or not being discriminatory in "certain" titles they choose not to sell?
