Extreme Associates Obscenity Case Dismissed

CHATSWORTH - In a development that surprised even himself, obscenity charges against producer Rob Black of Extreme Associates have been thrown out of court by a federal judge in Pittsburgh.

“I’m still speechless,” Black told AVN.com. “All ten counts against us were dismissed.” He said that Judge Lancaster had also ruled that obscenity laws are unconstitutional.

“I now have made fucking history,” said the jubilant Black.

“It makes everything perfect,” he added. “The business has been going great and all of a sudden my lawyer calls up and said I won.”

Black’s lawyer, Lou Sirkin, was not immediately available for comment.

Black said he’d been told that federal prosecutor Mary Beth Buchanan told a wire service reporter that she was disappointed and that she felt the government had a slam dunk case and that any jury would have convicted.

“This is the greatest news I’ve every had,” Black said.

Damn that's good news!!!!

It should clear the way for other companies who have been holding back.

If the ruling survives, Rob's lawyer - Sirkin? - is *the* hero, not only in porn, but in video games and mainstream Hollywood. He'll deserve a place of honor at the awards shows, even AVN (yeah I know it's a reach since he doesn't buy ads).

There was never any question that the government would appeal. The appellate court will almost certainly hear the appeal.

Whoever loses then will appeal to the US Supreme court. Whether that appeal gets heard is a lot less certain. Almost all appeals there get denied, yet this has the potential to be accepted to clarify the Lawrence case. That's not uncommon - a major new Supreme Court ruling often results in appeals being accepted a year or two later to clarify the original ruling, once there's been time for the problems and issues with the original to be seen. Rob isn't through, and his bills won't end any time soon.

If Rob will shut his mouth and stop talking to the media Sirkin might be get able to get a lot of the funding from mainstream Hollywood and the networks to carry the case forward. Those guys have been burned over last year and supporting Judge Lancaster's view of government regulation of morality is worth a lot of money to those guys. None of them care about Rob and they might stay away if Rob doesn't keep out of sight.

PS. It may be really important to Rob to have as much delay as possible at this stage. It's not in his interest to get to the US Supreme Court before Rehnquist is replaced, maybe not even before the appeal is heard. He doesn't want even oral arguments to take place before judges eager to curry favor with Congress to win a promotion.

Court Sets Argument Schedule for Extreme Case

PHILADELPHIA - The Third U.S. Circuit Court of Appeals has set dates by which briefs arguing for and against the dismissal of charges in United States v. Extreme Associates are to be filed – which means the case is on a fast track, even though neither side apparently requested it.

"The government's brief is due in April and ours is due is early May," said H. Louis Sirkin, the attorney for Extreme Associates and its two principals, Rob Black and Lizzy Borden. "The quick schedule doesn't surprise me, and I don't know that it means that the case is going to be moved on an expeditious basis. There's no record to be filed. The only transcript there would have been would be the oral argument, and that was typed up by both sides to do the final briefs, and that's all in the record, so there's really not a lot in the case that would usually cause scheduling delays."

"From my standpoint, we might as well get this issue moving," he added, "because I think it would be helpful to get this thing settled."

As things now stand, Judge Gary Lancaster of the Western District of Pennsylvania has combined ideas from several U.S. Supreme Court decisions, including the landmark Lawrence v. Texas decision striking down anti-sodomy laws nationwide, to conclude that Extreme Associates should not be held criminally liable for shipping sexually-explicit videotapes and DVDs, and allowing Internet access to explicit clips, to consenting adults – in this case, a U.S. postal inspector – in the Pittsburgh area.

However, there have been at least two other sex-related cases since the Extreme decision in the Fifth Circuit, where district courts in that circuit have concluded that the substantive due process liberties found in Lawrence are insufficient to strike down the federal obscenity laws. That situation, if the appeals courts in the two circuits uphold their own lower-court decisions, will give rise to what is called "diversity" in the circuits – a situation usually resolved by the U.S. Supreme Court taking one or more of those cases and rendering its own decision on the issues involved.

"I'm hoping that they [the Fifth Circuit] maybe will shed some light and open up because of Lawrence," Sirkin conjectured, "because they're the circuit that got reversed on Lawrence v. Texas, so maybe the circuit itself, with a different judge, might consider the issue."
