There is a coworker I loathe. I found a handy online database where I could look up arrest records. He has been arrested on two occasions, about a week apart. First time was for drunkeness & profanity. Second time was for DWI, two counts of possession (marijuana), and refusal to take a breathalyzer. What would have been the best/worst outcomes for this guy? I'm fairly certain he didn't go to prison, as we've been working on the same "team" since the time of his arrest. How hard (and expensive) is it to avoid prison for those charges?

about 2500 to start for the misdemeanor drunk/profanity/assault whatever. that's to his lawyer just to work things out. possibly a small fine after that MAYBE but charged doesn't mean convicted. cops will throw every charge they can think of at you and then it's litigation and usually settles out to one charge that gets plead out. 2 visits in front of a judge max. fact.

the dui... that's more expensive. about 8-10 after you jump through all the hoops. from what i hear.

Disorderly person, I'm going to guess $250-500 fine, depending on the muncipality.

He probably got Posession of CDS and Posession of Paraphernalia, along w/ DUI and Refusal. In NJ, those 4 charges would cost you about $5000 in lawyer, then he would eat the refusal, which would be all the fines and suspension of a DUI, but not the Insurance points.

The weed...depends on the situation. Lawyer will try to get the search thrown out. If that doesn't work, first offense, then conditional discharge. Like $800 in fines and a year probation. I'm not a troublesome criminal, so I didn't get a call from my probation officer until about 3 weeks left in the year. Schedules didn't line up, so I never actually saw the broad, just chatted on the phone twice. Good thing, because I started smoking weed again after 3.5 months clean.

Is this a white guy? If so, there is your answer. White people don't go to prison for petty drug stuff. Only BLACK people do.

We have our lives destroyed for small mistakes. White people get second chances up the wazooo.

My nephew had a DWI conviction. It cost him $10,000. Most of that was for lawyers but he also had to buy and get a breathalyser installed on his truck.

What were the circumstances that required the interlock device? Under the drinking age? High BAC? Second DUI?

In NJ they are common for repeat offenders, but rare for first timers.

In AZ, refusing to take a breathalyzer and/or blood test revokes your license for a year, though breathalyzer tests are inadmissible in court. You can sign a stipulation with the state DMV and have it reduced to 30 days revoked/60 days suspended (you can drive to work, school or for emergencies), but you have to have an interlock device for a year, at a cost of about $100/month.

Those wouldn't even be misdemeanors if he had a decent lawyer. The biggest offense is refusal of a breathalyzer.
