The judge in the criminal case effectively threw out the CO rape-shield law. I can't blame her for not wanting to face Bryant's lawyers under cross examination: you have no idea how vicious a well-paid lawyer can be. Think Max Hardcore a dozen times over.
The case wasn't "thrown out" per se so much as the prosecutors requested that for lack of evidence. Since the prosecutor didn't ask for the option of refiling the case Bryant's lawyer didn't object. It's embarrassing but it happens. It wasn't thrown out because of any request Bryant made.
You can bet the farm that she did NOT get any money under the table from Bryant. That would be witness tampering.
The civil trial is somehow in federal court? I had missed that. What's the federal issue here? Does the US have a rape-shield law she's hoping for use?
The standards in a civil case are vastly lower than in a criminal case. All the jury has to do is get to the "as likely as not" line and then tiptoe just a little beyond... Bryant will probably wind up paying a settlement but the big deal to him is that he won't have to register as a sex offender for the rest of his life.
The one piece of evidence I have never heard about that would be interesting would be what the "outcry" witnesses saw - when the people rushed to the scene after they heard her yell. What she said, how panicked she appeared, red marks on the skin - that would be of great interest. What little I've seen - and I haven't looked much - says nothing to me.

The deal might have been to let him have his moment for a few weeks after the dismissal, before any settlement.
She will surely seek $.
I'm conflicted about rape shield laws. On the one hand, if I ever got accused of rape, you damn right I'd want it allowed in if she fucks everybody she sees.
On the other hand, I understand that it's not relevant, and if it was my sister I would hate to see her go through that.
If she had accused two other people in the year prior(purely hypothetical, I'm just wondering), would that too be kept out by rape shield laws?
If she has a history of high promiscuity and emotional problems, what is to say she didn't change her mind as he was cumming, and went from there?
I realize true rape victims have been run through the mud in courts through the years, and injustices abound. But there has to be some balance.
I know this is all conjecture as I don't know what happened. If I had to guess I would say that he probably fucked her as she was saying no, and he disregarded it as indecision . . . . ie. rape.

LOL! I'm inclined to agree. But, I am reluctant to form an opinion since I don't know for sure.
Either way, she deserved to be assfucked.
If she is lying, then she deserves to be owned by Kobe for the rest of her life. That's alot of money and reputation he's lost if all he did was cheat on his wife.

Remember, the D.A. is the one that made the decision to file, not her, and the court is that one that was grossly incompetent in handling private documents, not just once but repeatedly.
When this started she probably reasonably assumed that the state rape shield law would not allow Bryant's lawyers to probe issues in her past unrelated to the charges. Well, the judged threw that protection out, released her name, released her private medical records, and in general appears to have totally lost control of his court.
The other thing is that I gather she has a different personal attorney now than before. This one may have given her a realistic preview of what Bryant would do with no rape shield law and with a judge unwilling or unable to keep a tight grip on the proceedings. I don't blame her at all for wanting nothing to do with it.
If anyone owes taxpayers their money back it's the incompetent trial judge, along with the rest of the judiciary for changing the rules so drastically after the charges were filed.
The group most affected, though, will be future rape victims. Bryant's entire strategy to this point appears to revolved around witness intimidation, and that strategy was permitted and worked.

Maybe. The truth is that we don't know what happened. She could have been outright raped. She could have changed her mind halfway through. She could have changed her mind afterward. She could simply be hustling for a civil settlement. Kobe could be a brutal rapist.
If he is innocent, then maybe he was just trying to traverse a flawed system.
I think one bottom line is that it came down to small town prosecutors against a no bullshit talented attorney.
If she had sex, anal or not, with days before or after her encounter mwith Kobe, then IMO that's relevant. I understand that is not the prevailing wisdom, but god forbid you or anyone you know should be accused of rape with anal tearing as evidence and then not be allowed to show other cause.
If she was raped, then sad as it is, she would have to be willing to suffer through a trial that most definitely would end up airing some of he dirty laundry(double entendre intended). That's unfortunate, but we shouldn't sacrifice truth because of it. She should stick to her story, and hopefully Kobe would be puished severely.
I just heard a report that she bled from her anus. Well, most anytime when a nonprofessional(lol) has anal sex with someone who is as large as Kobe no doubtedly is, then there will often as not be some blood.
She may have consented to fuck, and then he went rough porno style on her. She might not have expected it that rough and/or decided after the fact that it wasn't what she wanted. In that case I would be more inclined to call it simple assault, and not rape.
Of course, I'm speculating wildly, as is anyone else who thinks they know exactly what happened that night.

The irony is very rich. I watched In the Heat of the Night four or five times and gave my thanks to Dubya for making the world such a great place for blacks that white chicks who live in resort towns are suing them.  I know it doesn't make any difference in the long run, but after watching this case as it began for a week or so, I totally tuned out. With thousands of stories being filed every day by reporters, it starts to feed on itself. Or let me put it this way: I don't know of any case like this where thousands of hack journalists and photogs made things better. So it's pointless, but I don't pay any attention unless there's some point of law which seems interesting, like the holes poked in Colorado's rape shield law in this one.
