Oh Dan could sue, but he is a public person, and I would be able to obtain discovery on his full and complete medical history since the beginning of his porn career. (late 1990s) I would probably also need to depose his ex-wife, I'm sure she would have some interesting things to say about Dan's prior health and sexual history.

Dan would also have to disclose the form he filed out for Children's Hospital and unless he indicated he had paid for sex, or had sex with a sex worker during the previous year, he would have lied to them.

If sued, I would love to show the Jury, the Berlin You Tube clip and ask if, after that, was possible to damage this lout's reputation.
