Can a judge give "stipulations" that in this case are clearly unconstitutional -- in violation of the First Amendment? Mind you I am aware that such stuff is standard fare, but has anyone gotten the ACLU to challenge it? The Supreme Court seems very pro-free speech these days, what with the ruling yesterday that money equals speech and corporations have constitutional rights. Maybe they'll also have sympathy for the Janines of this world -- that or they'll demonstrate the depth of their hypocrisy.
