No one is accusing Brian Plumper of being HIV+. He did not place any of the girls in actual risk: he's accused of not taking a precaution.
There have been criminal prosecutions in the US where someone who was HIV+, and knew they were HIV+, infected someone else. Brian's situation is different because (1) he was actually HIV-, (2) he had no particular reason to believe he was HIV+, and (3) no one was infected by HIV.
Those three elements would seem to make a criminal case difficult. Had someone turned up HIV+ it would be different; had Brian been HIV+ it would be different; had Brian received a false positive result it might be different.
