Well, I don't know how it works in Canada, but in the US charges can only be filed using specifically stated statute passed by the legislature. Yelling "Hang'em High!" isn't good enough.
There are various "reckless endangerment" laws that might fit but keep in mind the gay lobby in California is very strong and disapproves of a lot of this sort of thing.

No. Privacy be governed by HIPPA, perhaps the only privacy law in the US with any teeth.
The notification you want can be done under HIPPA, but it has to be done carefully with strict adherence to the rules. AIM learned this lesson the hard way and probably isn't willing to get hit by HIPPA again.
