The rape case might still be tried - it was never finalized. But the victim is now a hostile witness and it's not clear what evidence they still have.
The victim's original statements aren't admissible unless there is a living witness left to testify under cross-examination as to what she said at the time. The prosecution could force the victim herself onto the stand but that's risky since she might shoot down their case.
The prosecutor who claimed he talked to the judge now says he lied about that. How much he lied, how often, and about what, is unclear. The judge is dead but at the time acknowledged "substantial misconduct" in the case at the time ... and the misconduct was never resolved because Polanski had fled.
BBC reported overnight that France is backing off insisting he be returned to France and that the Polish President has broken with their cabinet and opposes release. If France backs off I doubt the Swiss will let him go free. There is a US-Swiss extradition treaty and I doubt the Swiss will ignore it without France giving them cover.
The victim might not say anything against him anymore because maybe part of the settlement agreement was that she can't criticize him anymore. Her family was paid by Polanski. It was 30 years ago and the agreement might not apply anymore though.
She also says she forgives him. But how can she forgive him when he never once apologized and took responsibility for anything?
I don't understand why they would need a living witness when her testimony is on court records. It's not hearsay.
This has nothing to do with France or Poland. He was arrested in Switzerland for a crime committed in the United States. He's not a French or Polish diplomat or government official. So this has nothing to do with those countries and they should mind their own fucking business. They would be singing a different tune if we weren't extraditing someone who committed a crime in their country.

As to you folks that argue that the jail time is too little. Maybe you're right, but the fact is, his crime does not merit the death penalty (despite what many would understandably wish), so he would have received a finite amount of jail time.
The prosecution and the defence agreed on the appropriate length of punishment. Whether you think that was right or not, they had a plea deal that was (apparently) within the sentencing guidelines
The judge had the right to reject the deal. A favorable plea bargain was agreed to prevent the victim from suffering more trauma at trial.
The prosecutor who in the movie claimed he influenced the proceedings through an ex-parte conversation has now recanted the claim. The truth of what actually happened can be sorted out through the California Justice system once Roman is in country, and in a holding cell.
Woman testified that Roman plied her with drugs and alcohol before raping her anally. (She said no before he had sex with her, in her incapacitated state)
Roman later admitted to the police he had sexual intercourse with her, given this statement against interest, the rest of the victim's account is quite believable.
Even if you insist the victim lied, Roman jumped bail and fled the country. Marcia Clark said this act subjects him to a second charge of up to three years in prison.
By fleeing Roman tolled the statute of limitations on his crimes. Perhaps his defense attorney's motions should be granted and he should get a new trial on all the original charges and wait for his new trial behind bars because he is a flight risk. However, in a new trial every admission he's made over the years will come into evidence. The witness can be subpeona'd and if she tried to protect Roman her present testimony can be impeached through the use of her previous testimony before the grand jury.
In conclusion, Roman can go fuck himself.

Swiss officials have said they believe there is a very high risk of Polanski fleeing if he is released on bail. Temime told the Sonntag newspaper the Swiss Federal Penal Court should decide "very soon" on his bid for release on bail. "He would fulfill all the conditions and stay in Switzerland until the extradition proceeding are decided," he said. The director, who holds dual French and Polish citizenship, was arrested at the request of the United States when he flew into Switzerland on September 26 to receive a life-time achievement prize at a film festival. Last week, the 76-year-old director was denied bail by a Swiss court that ruled the filmmaker has a strong motivation to flee the country to avoid extradition to the U.S. The ruling marked the second time the Oscar-winning Polanski was denied bail since his arrest in Zurich. It is highly unusual for extradition subjects to be granted bail in Switzerland, says the BBC's Imogen Foulkes, adding that Polanski's first application was refused.
But this time the court ruled bail conditions should be enough to prevent him fleeing back to France, our correspondent says.
The ruling is not thought to affect the Swiss government's ongoing assessment of whether it should extradite Polanski to the US.
Polanski has not set foot in the US since fleeing the country in 1978, and has settled in France.
Speaking after detention in September, US prosecutors disputed claims that his arrest came out of the blue, saying he had been on an Interpol "wanted list" for years.

Polanski was accused of raping a 13-year-old girl after plying her with champagne and a sedative during a modelling shoot in 1977.
He was initially indicted on six counts - including rape by use of drugs, child molesting and sodomy - but pleaded guilty to the lesser charge of unlawful sexual intercourse.
Polanski fled the US on the day he was to be sentenced, and has lived in France since then.
