Why, he's already shunned from the show. He has nothing to gain by keeping his mouth shut. In a court, it would be Howard's burden to prove anything Cabby said was false. Plus Howard wouldn't want the to make a big ordeal out of it, since most of the press would love to write negative stories about him. Howard likes to play it up that she was a virgin princess that was wisked from Pittsburgh to the pages of FHM. The alleged reality is the biggest modeling gig she had pre-Howard was an Ames flyer.
Probably the only reason Cabby doesn't is that he likes Beth. If it was just bad mouthing Howard, I'm sure it would have already been done.
