Are you willing to take a quick quiz on well known cases to prove that you are a lawyer? The questions will be very easy for any lawyer to answer, but you'd have to answer fast so we know you're not researching.

I'm game, but you have to recognize that although all the initial training is the same, once we enter practice the specialties that develop are all over the board. I'm a corporate lawyer, working in M&A, early-stage venture investment (all but dead these days), a little bit of funds work and real estate. I know fuck-all about criminal law and Constitutional law -- the last time I cracked a book in those fields was 15 years ago.

It's like asking a heart surgeon about your prostate, or a dentist about your psychiatric problem. Sure, you'll get an informed-sounding answer based on medical training, and it would probably be fine. But it could just as easily be all wrong because the dentist isn't really on top of the latest developments in psychiatric care.

And besides, who in his right mind would want to masquerade as a workaday attorney? In my pretend life, I'm a hedge-fund manager who got out with a fist full of fuck-you money. Me and Skip Gates are yukkin' it up out at the Vineyard.

PS, smart guy: Lawyers always do research before answering a question, even one as prosaic as Is it raining? Research is what we do. It's the snap answer, tossed off without research, that gets you sued for malpractice.

Depends on when those 60 hours happen. They're not all contiguous -- so there's dead time during the day. Plus, you may not be aware, but there is an economic downturn going on. That has consequences for the billable hour.

Anyway, I thought the recent APB on me by Gia was prompted by absence, such as the kind one would encounter when a guy is working 60 hours a week.

Practical and procedural things only somebody who does that job for a living would know. I didn't spend 16 minutes on your silly quiz. It was seven -- plus I spent two minutes wrestling with how to see the questions while I was writing responses since the private messaging doesn't quote text. Finally had to open a second browser window (duh!). And I'm a speed-reader -- your five-minute expectation is nuts.

Anyway, no research by me. Just whatever I remembered from my first year of law school 15 years ago. Thank goodness nothing was from a second- or especially third-year class. Nobody goes to those.

At last, on top of the certification of the California Bar and the acclaim of my clients, I have the affirmation of an anonymous poster on a porno bulletin board. Now, finally, I can rest on my laurels. And go get some lunch. I'm famished.

One point of criticism: Your questions are exclusively Constitutional law. I'm not a Con law guy, and to be completely honest with you, Constitutional questions do not crop up all that frequently in most lawyers' working lives. Surely the teevee has given you that impression, but for most of us working schlubs it's something we studied in school then quickly forgot as it receded into the mists of time.

If you had gone to law school, you'd have known that. Or at least thrown in something from civil procedure, criminal procedure (which was my favorite), contracts or property. Con law was just one class out of six for half of the year.

As for free legal advice, get fucked. Nobody rides for free. I'm Rick James, bitch!

Your answers are correct, sir! You pass first-year Con law. Was it a five-minute quiz for you?

I think the "emanations from" phrase refers to "emanations from penumbras" -- Justice William O. Douglas wrote that “specific guarantees in the Bill of Rights have penumbras, formed by emanations from those guarantees that help give them life and substance" in Griswold v. Connecticut. But in responding to Coke's quiz I had only a vague idea that the right to privacy was based on inferred principles "emanating" from the Bill of Rights -- I had to look up the "emanations from penumbras" phrase after the fact.

I made the same quibble with Coke's quiz on question 7, as the 3/5 rule comes from the Constitution itself and not from a case. I still don't know for sure -- do you imagine his question sought to elicit the Dred Scott Decision?

Lemon v. Kurtzman was the one I had no clue about.

As I intend to run for public office, or perhaps accept nomination to the Supreme Court, I'm leery of having my comments here on the porno bulletin board coming back to haunt me. But here goes: In general, I support liberty and that means a general approval of personal privacy. (I'd prefer it to be established by statute, however, rather than imaginary emanations from the Constitution.)

Roe v. Wade was wrong, because it so casually disregards the interests of the actual human being whose life is to be forfeited. The rest of the Griswold line of cases doesn't bother me -- particularly the ones concerning the right to sodomy. I approve of sodomy. So no, I don't believe Douglas should have been jailed as an enemy of the Constitution. I do wish his opinions were more rigorously thought-out. But in my opinion, although our general politics do not agree on so many things (I don't get the idea that Douglas would have been a big Sarah Palin fan, as I am, and I certainly don't think trees and rivers should have legal standing), I agree with Justice Douglas that the objective of the Constitution is to get the government off people's backs.

What a half-assed attempt to provide an excuse, more likely you had to take the wife and kids to Disneyland for the summer. This is close. Tell me which 40 year-old lawyer isn't doughy around the middle and losing his hair. And I surely ain't the boss of anyone other than my assistant and the poor associates who depend on me for assignments, so I guess I'm in the middle of this place. The only thing you're wrong about is the haggard wife. I dumped her a few years back. If I get married again (might not), it would depend on Gia's availability.

1) Griswold v. Connecticut.

I tested it with two videos yesterday on slut.load - both are down now.
