I too was always under the impression that it was illegal. Recently though, I was visiting a porn shop in Vegas and they had German gay anal fisting movies featured in the theater. That's pretty hardcore (I bought 100 tokens and watched it 45 times ).
However, I do think fisting is still controversial enough to bring out the worst in some DA somewhere in America.
