You're mixing your metaphors there a bit:
Mental illness is a medical condition and insanity is a legal condition.
There's a bit of a catch 22 there also... if a person can stop themselves from acting insane once they are insane (because of how they or others in society are treated), then they could never have been insane in the first place.
Also, even if the person had a previously existing legitimate mental illness, I don't see why there shouldn't be consequences for their actions, and that the severity of those consequences should be mild for mild infractions and severe for severe infractions.
