A Tampa judge denied bail Wednesday for a Florida man charged with first-degree murder in the death of a 3-month-old child, who authorities say was thrown out of a moving car. Police say infant Emanuel Murray died after his mother's ex-boyfriend threw him from a car on a Florida interstate. "I almost passed out, I started shaking," said Bird. A preliminary autopsy determined the child died of blunt trauma to the head, the county medical examiner's office said. Police were called to the apartment of McTear's former girlfriend about 3:15 a.m. Tuesday. The mother, Jasmine Bedwell, 17, told investigators that McTear had hit her several times and threatened "to kill the both of y'all," the sheriff's department said in a statement announcing the charges. McTear threw a car seat containing the child across the room during the fight, causing the boy to fall onto the apartment's concrete floor, investigators said. He then picked up the boy and drove off in his blue Chevrolet Impala, throwing the child out while on the interstate, the sheriff's department said. Video on CNN affiliate WFLA TV showed McTear being led out of a Tampa police squad car after his arrest. He ducked his head as TV cameras surrounded him on his walk into a police building. When asked by reporters if he had thrown the child out of the car window, McTear answered, "It's a dirty game. A dirty game." McTear is not related to the child, said sheriff's spokeswoman Debbie Carter. McTear is facing additional charges of burglary with battery, felony battery, aggravated child abuse and kidnapping, the sheriff's department said. LINKI like to consider myself a pretty creative and imaginative person but I can not even begin to think of an adequate mode of punishment for this waste of molecular structure.

It is not safe for the person to be among the rest of us. We do not kill, we do not torture. This person should be shunned from our society, but there is no good reason to abandon the very principles we use to hold him to task. But that is just my point. Uh, the fill in any word you want to use part... I think the words everybody else wants to use are criminally responsible.
The fact of the matter is that he is most probably not legally insane, and there is not a mental illness that would excuse what he did. Neither of these are issues of semantics. Everybody is entitled to believe whatever they want about capital punishment, but to throw around words meant to justify your position (e.g. he's "insane" so shouldn't be killed, or he's "mentally ill" and so shouldn't be killed) that are factually incorrect don't help.
In other words, if your position is that we shouldn't kill him because he is either mentally ill or insane and then he is pronounced to be neither mentally ill nor insane, why shouldn't we kill him? I wasn't trying to be nit picky about how you used the words, this was the point I was trying to make.
I guess it's just my opinion that a person should have the courage of their convictions to say, "Sure the guy beat up a woman, kicked an infant across the room, kidnapped the infant and then beat it up some more and threw it out the car window on the highway to die by the side of the road and he isn't insane and he isn't mentally ill, but I don't believe in the death penalty so he should be taken care of and supported by society for the rest of his life."
Anyway, I wasn't trying to be nit picky about semantics (there are enough people around here who do that already), or attack your position, I was just curious about your thoughts against the death penalty without the crutch of mental illness or legal insanity to see if they still held up. I don't think you have to justify your position, I was just curious, that's all.

I don't think there need be any finding here as far as mental capacity or sanity or whatever. If you do something like this, you should be humanely removed from society. If cops and shrinks want to examine him, I guess that's up to him, but it should have no bearing on what is done with the guy. Lock him up, care for him in a humane manner, and that's it. Same for repeat pedophiles, serial killers, and Alex Panzer. Life in prison, no parole.
But don't soil our collective hands by torturing prisoners or killing them, or failing to provide minimal things like security and medical aid.

You are correct in stating that I did not sound like somebody who supports the death penalty. I am weird that way. I believe in intellectual honesty. These (as I understood them) were the dispassionate facts. I know nothing more than what was reported (correct or false in it's accuracy), but these were the facts everyone was using to state their position.
According to what I read:
He did hit the mother
He did kick the baby
He did kidnap the baby
He did throw it out the window of his car on the highway
The autopsy showed additional injuries consistent with beating it before throwing it out the window.
Nothing supports the claim of legal insanity.
Nothing supports the suggestion of mental illness.
Charin, himself, suggested "humanely" warehousing the man for the rest of his life; which demands that all of us give a portion of our income in taxes to support him for the rest of his life.
According to what I read, these are the facts that we were presented with. Being for or against the death penalty should not allow you to twist the reality to suit your position in order to make it more palatable for you or to make your argument stronger.
I was intrigued that Charin had the balls to stand up to those facts and state his opinion, and wanted to learn more.

I hope they do have the death penalty in florida . People living there shouldn't have to pay taxes to the state for life to keep him in jail for life .
Charin , if he does get the death penelty , he will probably be on death row for about 12-15 years . He can make many license plates while in jail for the U.S. during that time . Just think of that as self re-habilitation and his way of giving back to society and making up for killing a defensless child. Should make you feel better about the whole situation

Not true. Honesty demands I admit that I did not (and will not) read the article you attached. I have had too much to drink and am busy watching TV while I am writing this, so I cannot also read articles--maybe tomorrow. I disagree with your assertion, but even if I did agree with it, it is the difference between what *MAY* cost more and what is a definite certitude.

as far as i know, (and i'm not claiming to be the most informed person in the world on capital punishment issues, so if someone has some credible information i'm not aware of, please jump in here) it's not really debated that capital punishment, as it exists now, is outrageously expensive, (much more expensive than life in prison) due to the process. as i understand it, pro-capital punishment peeps counter this by arguing that we should streamline the process, (eliminate "dubious" legal maneuvering, limit appeals, etc.) making it more cost effective to obtain and carry out death penalty sentences. i do appreciate your intellectual honesty in saying you didn't read the article you're disagreeing with, though. respect.

FL and TX often race to see who can click the lights off of more convicts. But, Utah is my favorite with hanging and firing squad still on the books.
Now as for how to actually click those lights off, may the Geek suggest a quick reread of history. Nobody did it better than the Romans. The Inquisition came in as a close second, but the difference is that the Catholics were not actually trying to kill the poor piece of meat at the center of attention, but were just looking to clear their mind a little-- or, at least, that was often the offical story.
