Buchanan is a Bush appointee. Obama (unlike Bush) hasn't fired any federal attorneys yet. He may be waiting for their terms to expire before Holder replaces them. I seriously doubt that the AG or much less the President is micromanaging what the disposition of a legacy case like Black's is.

The trial judge is the same guy who threw out the charges in the first place. Black & co may be hoping for a lenient sentence.
