www.xbiz.com reports a story in which L.A. Direct Models posted a notice Christmas eve on its website claiming that it was
exempt from the effects of the 2257 statute, that it didn't recognize 2257 as valid law and that LA Direct also didn't recognize US jurisdiction. The notice further stated that all content displayed on the website was created before July 3, 1995.
After XBiz contacted them regarding the notice, the agency took the notice down.
L.A. Direct Models owner Derek Hay had no comment, but two adult industry attorneys weighed in.
“If they have an argument as to why they’re not in California, I don’t see it here and I don’t understand what they mean,” Chicago-based adult industry attorney Joel D. Obenberger told XBIZ.
Adult industry attorney Greg Piccionelli of Piccionelli & Sarno noted that legal advice should be solicited in order to prevent similar snafus in the future.
“I would be very careful about making an announcement that you’re exempt from 2257 before seeking counsel,” Piccionelli said.
