I don't think the industry should get too comfortable with putting "This is Not" in front of every piece of merchandise as a way of ducking a potential lawsuit. Jeez, if it was so foolproof, one could put "This Is Not Obscenity" on the top of every box-cover and sleep soundly. Sooner or later there will be a "This is Not" test case. Will it be "This Is Not Lawrence Welk --XXX?" Or "This Is Not Leave It To Beaver--XXX?" And will the defendant respond to the subpoena with a reply: “This is not a lawsuit is it?
