Courtney Love 'suffers miscarriage'

TROUBLED American rock diva Courtney Love was admitted to a hospital hours after a Californian judge issued an arrest warrant for her when she failed to appear in a a criminal court hearing on her 40th birthday.
Love was rushed to a hospital in New York, to be treated for what KCBS television said was a miscarriage, after she skipped a court hearing in Los Angeles to in which she was to face charges of assault with a deadly weapon.
"She is conscious and in stable condition," Love's Los Angeles lawyer Michael Rosenstein said in a statement.
"This is unrelated to any type of substance use or abuse," he said.
The flamboyant actress and singer is currently facing two unrelated drugs charges as well as the assault rap.
"This is not (an) injury related to any altercation, nor is it a suicide attempt. We categorically deny that it has anything to do with drugs," said the lawyer.
Earlier in the day, Mr Rosenstein told Los Angeles Superior Court Commissioner Dennis Mulcahy that Love was in New York and was confused about whether she was required to be at the hearing.
Judge Mulcahy was unmoved. He issued an arrest warrant, ordered Love's $US55,000 ($76,500) bail forfeited, and reset the bond at $US150,000 ($208,500).
"Why should I treat her differently from anyone else who fails to show up?" Judge Mulcahy asked Mr Rosenstein.
The judge said he could find "no legal excuse" for Love's failure to appear for arraignment on a vserious matter".
Prosecution spokeswoman Sandi Gibbons said Love would be arrested if and when she returns to California.
The charges stem from an April 25 run-in Love had with a 32-year-old woman who alleges Love struck her with a bottle and a metal torch.
"Miss Love has no intention to hide from these charges," Mr Rosenstein said outside the court. "We do believe that there's no merit in the charges."
Love "had a confusion with respect to the date", Mr Rosenstein said, noting that she has two other criminal cases pending against her.
"Currently the court looks at her as a fugitive," her lawyer noted.
"She will be coming before the court and bonding out on the matter and giving a full defence to the action," he said.
Love, the widow of legendary grunge rocker Kurt Cobain and former Hole frontwoman, has recently had a string of brushes with the law.
She was arrested for being under the influence of drugs following a fracas at her boyfriend's home on October 2, and was then rearrested for drug possession later the same evening.
She is awaiting sentencing after pleading guilty in May to being under the influence of drugs.
Love is due back in court on July 15 on the charge of possessing the drugs oxycodone and hydrocodone. They were reportedly found when police and ambulance crews rushed to her home before she was taken to hospital for a reported overdose.
Her child with Cobain was taken from her care at that time.
Love also faces assault and reckless endangerment charges in New York after she threw a microphone stand into the audience in a nightclub, injuring a fan.
Love has had at least two other run-ins with judges in recent months for either failing to be in court on an appointed date or turning up hours late for hearings.

Can she? I've not been involved with the wrong end of the criminal justice system myself, but I seem to remember that in Texas bail can only be made by a licensed bondsman. So she'd probably have to pay a bondsman the entire bond, in cash, up front, plus whatever other fees and expenses the bondsman would incur if she forfeited again.
I'm a little surprised that none of these judges has thrown in the towel, declared her a flight risk, and denied bail, or at least put her on a very short leash with no travel rights.

Totally unrelated to this, except that I once had to spend the night in Huntsville, where they execute all of the Texas prisoners. Weird vibe in that town. I half expected the lights to start dimming.
Anyway, every state's laws are different. In a number of places, bondsmen are only required when summoned for a loan or when property is used as surety.

Secondly, it's a matter of fact that women charged with violent offenses often get bail, even when the crime is especially heinous. I doubt she has a worse criminal record than Tommy Lee, to take a male celebrity equivalent, but I'd be surprised if she ever spent more than a few nights in jail even with a hard-ass judge.
As for this miscarriage, it looks like a set-up to me. It rarely works. A judge is God in his courtroom, and she's pissed off God.

I recall two reasons for the law in Texas:
1. The Bail Bondsman association made a lot of political donations right about the time this law passed.
2. Bondsman and their agents can still get away with things that are unconstitutional for police when searching for someone who’s jumped bail. Plus, a bondsman has financial incentive to find someone and bring them in, and the state doesn't have to pay for it.

My dad is a semi-retired judge who mainly handles cases for local judges who go on vacation etc. It’s really hard to piss of a judge worse than by not showing up, or being hours late. It’s probably worth a lot of money on the fine to be on time. I doubt many people realize how big a deal this is to a judge.
As for the miscarriage: the judge has heard it all a thousand times before. You can’t think of an excuse that hasn’t been tried already. That “miscarriage” was probably a PR thing – I can’t imagine they’ll try that in court.
Finally, the judges don’t live in a vacuum. They all know she's late for or skipping appearances all over. I'll ask, but I'm pretty sure that while bail must normally be granted there comes a point it can be denied if it seems the perp won't show up. All of the judges know she's strung out, and all of them know she'll be dead in months if not weeks. If they have the option at some point of putting her in a cell they might do it as the last chance to save her life. It may be that what's helping her here is that as bad as she looks, she's not the worst that comes through the court every day.

I could (stop flipping me the bird--I could but I won't) tell you a million stories like that. And I'm not that old. One time, an out-of-state attorney that I helped to admit on motion until his client had time to find a member of the state bar found himself facing a complaint from a judge to his own state's bar association. The judge complained that he was being contentious and rude. Why? Because where he was from (Florida), attorneys often addressed the judge as "judge" as well as "Your Honor." This struck this judge as some kind of deliberate insult. The judge said nothing during the hearing. Just quietly noted how many times he addressed him as "judge" and had his clerk file a disciplinary breach.
Another judge hurled a filing across the court because the original was copied on off-white paper.
Judges fall asleep more often than I ever would have believed. It makes no sense, since they can and do interrupt witnesses in the middle of testimony if they want a 15 minute break. One ate potato chips in the middle of testimony and kept chomping so loud that the court reporter kept asking for everything to be repeated. He didn't stop until he finished his Cheetos.
If you want a good justice system, a good start would be to make every attorney that wants to practice eligible to become a public defender by a random draw, rather than the yutzs and unemployable scoundrels who now inhabit the average public defender's office. You get a lottery number, you're assigned a case at the state's expense, just like it is now. It'll never happen though, because 90% of the politicians in this country who could put something like that into practice are lawyers themselves.
Oh, and, uh, I like porn.

I hear you on that. I had some serious legal problems last year and was looking at 10 to 20 on a felony charge because of some crackhead and I was treated like a criminal,even thou I have no priors, while this crackhead was giving special treatment as a victim. In the end,I prevailed and this fuckhead got in some serious shit for filing a false police report. The judicial system only cares about convictions and not the truth. 
that is some serious truth. i did jail time for self defense
