I am not familiar with Federal sentencing guidelines as they pertain to Paul Little's situation, but my hunch is that Jim B. is in the ballpark, and like him I wouldn't be surprsied if she incarcerates Little pending appeal. I don't really approve of Max Hardcore stuff, but am dismayed that Little faces likely incarceration, and apparently his disposition date is imminent, isn't it?

Ivor, IIRC, he faces a maximum of five years on each count, so that's a possible total of 50 years. The 12-18 month figure was just until the Eleventh Circuit hears it. Longer if it goes to the Supreme Court.

It's all going to depend on the sentencing guidelines. In the Federal system it's all based on a point system. The only leeway a judge has is to sentence to the top of the guideline or the bottom (ie: 18(low end) to 27(high end) months. The amount of points he has sets the amount of time. If he "pled" he would receive a "downward departure", which means they would take points "off". For instance there would be -3 points for "acceptance of responsibility" and -3 more points for pleading under the auspice of "cooperation". But since he did not plea, he's already starting high, and based on the severity of the crime he's been convicted of it will add more points. Meaning how many points you receive for the crime, murder I believe is +33, drug trafficking is +20, white collar crimes ranger from +6 to +10, so it's all going to depend on where he falls in the points!

In a lot of Federal cases, you see people who plea get 12-18 months on a certain charge, but people who fight the same charges would get up to 5 years, again, losing the points for acceptance of responsibility and cooperation, and any other downward departure associated with a plea. My guess would be somewhere upwards of 36 months. Vick got 27 for dog fighting, Max is getting more than that!

Man, I hate the way he's getting railroaded. The whole thing is just disgusting. The DA asks the distributor to give them copies of porn that aren't even for distribution in Florida, gives them immunity and then charges Max. Why the hell is that even legal? That sounds a ton like entrapment to me.
