That would be where the producer is the director and the “talent” as well.
Also for bonus points…..if Homegrown video was to compensate you for a film shot out of the state of California…..send a check to Alabama…since the couple lives and shot the video there……is that type of shoot legal……..now remember that Homegrown is a California company.

Commercial renumeration doesnt get you there. Its a First Amendment issue, not a commercial issue.
POV is not covered by Freeman. Actually the fact that the producer was not receiving the sexual gratification from the act was a big reason the court decided in Freeman's favor.
As for Homegrown, never really thought about it, but since the performers were not contracted to a perform sex scene by the production company it would be hard to prove prostitution/pandering. Dont really have a better answer for that one though.
and waht about big companies like bang bros and reality kings?
