I'm several years from having the financial stability to seriously consider anything like this... but the day will come! heheh
anyways, I was wondering what legal issues I should concern myself with when starting my own website (e.g. in California vs. Florida vs. Wyoming).
Also, I will be a professional in healthcare (looking to keep everything extremely separate!) It sounds shady, i know, but I'm just entertaining the idea. Can anyone direct me to some legal resources or share some experiences?

If you want to keep it secret become an investor. Don't EVER think you can work in porn at any level and not be outed to the public. Naive.

You know, you can buy equity in private companies. It's called private equity. You don't have to acquire equity to be an investor in a private venture though. There are many ways to structure investments.

Not nearly as much before, but there were a few incidents. I ended up telling my family way before it ever aired so there'd be no surprise. But even with very little exposure someone's cousin's, brothers, monkeys, uncle is gonna eventually find out and spill the beans. Porn is forever... it can never be taken back.

Technically its illegal to shoot hardcore outside of California. California has a case called Freeman that protects the First Amendment rights of producers to pay others to have sex on camera for commercial distribution. Everywhere else it might be considered prostitution/pandering.
You cant stay under the radar and own a company in the US. With 2257 you are required to put your name on your website as well as your office/home address. Hence the chilling effect of the law.
You can check out my site www.AdultBizLaw.com for more info. Or use google its a wonderful tool.

That's what I needed to know. Thanks! I expect to have a well paying job after school to finance this 'project'; so I'm not really worried about makin' money so much as havin' fun for awhile I'm basically worried about keeping it on the downlow, which means it's alright if some people know, just maybe keep it separate from my day job. Amature allure seems to do an alright job of that, although I've never really looked through his website too intensly.
Anyhow, thanks for the direction; I will definetely be looking into your website for any legal deadends!

Could it also be explained as in where actors receive commercial remuneration for their performance on camera? ….AKA…getting paid to get laid on camera.
Just to confirm…..does it also indemnify producers shooting POV style films…..
That would be where the producer is the director and the “talent” as well.
Also for bonus points…..if Homegrown video was to compensate you for a film shot out of the state of California…..send a check to Alabama…since the couple lives and shot the video there……is that type of shoot legal……..now remember that Homegrown is a California company.

and what about florida?
If you cant tell from the Max and Ray cases, Florida is not porn friendly. Miami-Dade County might be but Florida is run by the Bush Cartel.
And yes its illegal and there's even a law on the books in Florida that says a whore can sue her pimp for profits and it includes porn.

Dino always asks the best questions....
Commercial renumeration doesnt get you there. Its a First Amendment issue, not a commercial issue.
POV is not covered by Freeman. Actually the fact that the producer was not receiving the sexual gratification from the act was a big reason the court decided in Freeman's favor.
As for Homegrown, never really thought about it, but since the performers were not contracted to a perform sex scene by the production company it would be hard to prove prostitution/pandering. Dont really have a better answer for that one though.

Crap, so producing AND starring in my own porn is out of the question, huh? I basically have to find a producer who will let me do what I want. I was hoping to work on this at my leisure as I will be working on my professional career most of the time.
Can I get a business partner and just take turn shooting?

Well its a toss up in Miami-Dade....Few years back...Gambling groups proposed putting type II slots in gaming operations that were NOT on tribal land.....then Gov. Jeb BUSH came down to talk to the locals on the dangers of gambling....the measure did not pass in Miami-Dade...however it did pass in Broward...Palm Beach is also pretty liberal too. So South Florida is usually leaning toward the left. It is just like its counterparts in West Central….Hillsborough & Pinellas (Tampa/St. Pete) where they convict Max one day and the next Dirty D is shooting in one of their many porn theaters.
But then again we have people calling 911 about how their subway sandwich was made (Jacksonville- Duval)!
I have said it before....Florida is one FUCKED up state!

^^ In Cali, no ones going to prosecute you for shooting POV porn. And for under an ounce the max you can get is a ticket, and that's only if you don't have a medicinal card. All other states suck!

The only time I ever saw cops openly allowing people to smoke weed was during the 4th of July celebration in certain areas of the District of Columbia.
Maybe US Reps. Barney Frank (D-MA), Tammy Baldwin (D-WI), Earl Blumenauer (D-OR), William Lacy Clay (D-MO), Barbara Lee (D-CA), Jim McDermott (D-WA), and Ron Paul (R-TX) will halp HR 5843 get somewhere...

^^ If you have a medicinal card and are not operating heavy machinery (i.e., driving), you can pretty much toke up anywhere smoking is allowed. Welcome to KAHlifornia.

^^ Naw. Stay where you are and change your own laws. One out of every ten people in the country already live here. Those midwestern states aren't taking their fair share.
