Cause the winning bidder also "stars" in the film. Even in California with Freeman protecting adult content production, the reason why the Supreme Court held content production was not prostitution was because the person paying for the sex wasnt receiving the gratification. Under Freeman, even POV scenes would be considered prostitution.
Almost every month I get a call from someone saying they know the next big thing in the industry -- a pro/am series with normal guys fucking pornstars -- and the normal guy in the scene pays for everything - cameraman, lighting, location, girls rate ect. Again, its filmed prostitution.
Would that operation get busted in LA, maybe maybe not. But if it did, you're probably going to jail -- go ask Ray Guhn.
