It's probably a question of a proper contract. Courts can be real sticklers for dotted i's and crossed t'd in such cases, and pay attention to how the agreement is reached to decide if it is a valid, fully-informed contract. I know pre-nups have been invalidated in Texas over as little as the attorney advising the wife having been the husband's usual attorney.
