TAMPA — In a surprise revelation, James F. Komurek, president and owner of JKG, Inc. and Jaded Video, testified that it was his company that mailed the five DVDs for whose interstate transport Max Hardcore is being tried.
Komurek testified that when his company, which is both a retailer and a distributor, bought videos from Max World Entertainment, as it has from almost every other adult video producer in the Los Angeles area, he assumed all control over the discs, and that Hardcore had no knowledge that Jaded Video was sending the five charged videos to the Tampa, Florida area, nor that it was using the U.S. Postal service to do so.

He also testified that he had not spoken with Hardcore regarding any portions of the country to which such DVDs should not be sent, and he confirmed that it was his company which received and deposited the postal money orders which were used by postal inspector Linda Walker to pay for the DVDs which were eventually used to charge Hardcore with interstate transportation of obscene material.

Finally Getting Around to the Jaded Video Issue: Max's Lawyers Say He Didn't Mail DVDs To Tampa
TAMPA - Defense attorneys for a California pornography producer, charged with distributing obscene materials through the mail, tried to prove to a jury Friday that their client didn't mail the DVDs to Tampa – an independent distribution company did.
Federal prosecutors, in turn, tried to show that Paul L. Little, who goes by the name Max Hardcore, sanctioned the distribution.
Pat Doherty, a St. Petersburg lawyer not affiliated with the case, said it sounds like the defense is trying to tell the jury that, regardless of the obscenity question, Little is not responsible for mailing it.
But that tactic may not work, Doherty said.
If it was foreseeable to Little that the items would be mailed, he is responsible for the mailing, Doherty said.
The independent distributor, James K*****, said he was testifying only because the federal government gave him immunity from prosecution. Anything he said on the witness stand could not be used against him.
When questioned by defense attorneys, K****** testified that his California company, Jaded Video, buys DVDs from Little's company, MaxWorld Entertainment. K****** marks up the price and sells them via his Web site.
MaxWorld sent the DVDs to Jaded Video via the private shipper UPS. Jaded Video then sent the DVDs to buyers around the country via the U.S. Postal Service, including shipments to Tampa.
K****** testified that he did not discuss with Little where his shipments were sent or through what service.
K****** also testified that he is still offering the DVDs that are at the center of the obscenity trial.
Asked whether he would continue to ship the movies to Tampa, K****** balked.
"At the end of this case, I'm going to confer with my attorneys," he said.
Federal prosecutors asked K****** whether Little was aware that Jaded Video was distributing his movies commercially. K****** said that was self evident.
Prosecutors also pointed to language on Little's Web site that says none of his movies can be disseminated without his written permission.
Little and his company face five counts each of distributing obscene materials over the Internet and five counts each of distributing obscene material through the mail. If convicted, each charge includes a maximum punishment of five years' imprisonment.
Jurors will have to determine if the material is obscene by contemporary standards for the Tampa area.
Wednesday, Thursday and today, jurors viewed almost every segment of five movies — including scenes where Little has rough sex with women that includes forced sex, violence, vomiting and urination.
When court resumes Monday, jurors will have several more hours of movies to watch. The case is expected to conclude Tuesday.

Not if the republicans get another chance....McCain may select Charlie Crist (Gov. Florida - R) for his VP or maybe even as Attorney General...he already was Attorney General in Florida. Both of the cases currently in Florida are definitely pandering to voters in an election year.

McCain's likely choices are Romney for VP and Rudy for AG. I'm not worried about either of them. Romney never moved to ban porn as a Marriott director when he had the opportunity to doo so. And Rudy's mid-90's pornophobia was based solely on the economics of Disneyfication. it was about as transparent as Bob Barr's U-Turn on drugs, or Obama losing, then suddenly finding, his flag pin, or McCain on the GI Bill.

I dont know Jim....Mormon = Romney and Rudy has a bit of a checkered past as well for a Republican...remember they are the family values ticket....well except for NO CHILD LEFT BEHIND....but were all not perfect.

McCain will name an idiot as VP and he will lose. Which in a way, for me, kinda sucks because I like him. But Obama is having greatness thrust upon him. No doubt. Once in a generation, and they say that is every 33 years. I worked for McCain in 1999. And I can tell you, he is rarely a Republican. He is a Maverick. He is excellent. And to see him pander for WH support makes me not sick, just sad. He'll retire from politics after Nov. 4. (Fuck you Max Fose) He'll drink shitloads of beer with that blonde hottie! Well this one is a rather hard one to call then....imagine if there was an election...and no one came out to vote....
or by some bizarre occurrence..there actually was a tie....I am sure there is SOMETHING in constitution preventing such as thing....what is it...the supreme court decides or something? oh yes I forgot about the Electoral College...
This election needs some drama in it!

Ummmm. The 25th amendment covers filling the presidency if the president is incapacitated and the filling of the Vice Presidency if vacant. [Actually the first time it was used was to filled it on a resignation, Gerald Ford for Agnew].
Like the Constitution itself, there is no assignment of succession beyond the Vice President in the 25th Amendment.
The succession order is from the "Presidential Succession Act of 1947" which replaced the one from the 1880s. It has been amended at times since ... like when Homeland Security was added to the cabinet.
Congress' power to delineate the order of succession is based on the powers assigned to it by Article II, Section 1 "the Congress may by law provide for the case of removal, death, resignation or inability, both of the President and Vice President, declaring what officer shall then act as President, and such officer shall act accordingly, until the disability be removed, or a President shall be elected."
Haig once explained that he was acting on the succession as he learned it in school as a child - which placed the Sec of State after the President.
btw, the 25th Amendment also "legalized" the interpretation of John Tyler that the Vice President assumed the office. After Tyler's "usurpation" this became the practice. It is unclear what the framers intended when a President died. Many believe that they intended the VP to serve only until a special election could be held and not the VP taking over for the remainder of the term.
