In his answering affidavit, Matsebula alleges that the problems between himself and his first wife, Phumzile, began on the night of Sunday, December 8, 2007 when he attempted to get intimate with her.
“The true position is that we got intimate with the applicant (Phumzile) and as we cuddled, I discovered a used condom in her private parts, in her vagina to be precise. I then questioned her about same and she apologised to me saying she was tempted to commit adultery the previous day because she had been drunk and thought that I would not become aware of same, and I told her that I was going to discuss the matter with my family. I accordingly consulted with members of the Matsebula family and I was advised that as per the dictates of Swazi Law and Custom I should take her to her parental home, which was a way of initiating talks between the two families as provided for in terms of Swazi Law and Custom, and I obliged and took her to her parents,” says the city council boss.
On the other side of the coin, Phumzile denies that Felix ever found a used condom inside her.
In her founding affidavit, she explains in detail the events of the night of December 8.
“After I had taken bedding, changing clothes and toiletries to my sister’s child, on my return at about 7:30 p.m, I found respondent (Felix) home in the company of his niece. I then whiled away time adjusting our youngest child’s slacks in preparation for her next day at pre-school. Shortly after going into the master’s bedroom, respondent came out and instructed me to join him in the bedroom. I was apprehensive since I had suffered numerous assaults from the respondent, with each assault having me admitted at the Mbabane Clinic. Shortly after having joined him in bed, he proceeded to insert his right middle finger into my private parts. He proceeded to move his finger around as if in search of something, and later withdrew his finger and clenched his right fist, holding something. Respondent then went on to tell me that he had removed a condom from my vagina passage. I was shocked at his allegation of having retrieved a condom from my private parts, mainly because respondent’s allegation was unfounded and untrue,” Phumzile contends.
She further explains that after this encounter, Matsebula then put his clothes on and left the marital home until 10 p.m.
And when he returned, he instructed his wife to leave the bedroom as he did not want to see her.
For the next few days, Felix stopped eating food prepared by his wife, and also stopped communicating with her.
On December 13, 2007, he is alleged to have locked his wife out of their marital home at Queensgate as he changed the locks and replaced them with new ones. On the same day, he is said to have taken their three children to his parental home, Maphungwane. “The respondent clearly has no right to have our children and I so painfully evicted from our marital home whilst he continues to live his life peacefully with his second wife and family at their common place of abode at Makholokholo.”
The matter continues at the High Court next Monday."
