Let's says that somehow she was be able to prove that she got Herpes from a particular scene. According to my understanding from a thorough reading of Pornlaw's posts, in California she might be Workman's Comp eligible since film actors have already been found to be employees and not independent contractors [even if they sign/agree that they are/were independent contractors].
While I cannot see this possible with something as ubiquitous as "the Herp", it might very well be possible with HIV [DNA and infection trees being what they are]. So, this remains a "hot button issue" with Mr. F since he sees the industry as being very exposed.
I'm sure that the argument is that since she is an independant contractor she is not entitled to workers comp. It would of course depend how the paperwork is drawn up.
However, if Brendon did not inform her that he had the herp, she was infected by the herp, and it was somehow traceable by DNA to him, I wonder if it this could form the basis for a civil suit for intentional or reckless assault because Brandon didn't appraise her of the risks his "touching" could bring and therefore she couldn't consent. Certainly given his prior knowledge of his condition the injury would not be due to negligence so it would have to be caused by a reckless or intentional action.
I have no clue about the legal side of the industry, but it seems rather seldom for production companies to cover anything, according to Mark Davis in a clip from behindkink.com.
