CPS can step into a situation involving a child for basically any reason. They are there to protect children. The final arbitrator will be a judge though. The hearing as to custody will eventually find its way before a judge and he/she will make the call.
CPS can be overly zealous with their decisions at times.

This actually happened to us with my little sister. Someone reported that my mother was shooting adult with her present, so someone came down from Child Services to interview her. We think an unfriendly neighbor made the call. Of course nothing came of it, and the woman who interviewed my sister apologized for the intrusion and said it was obvious that there was no misconduct on my parents' part. It was pretty scary, though! This was obviously years ago, as my sister is 21 now.
