Legitimate media companies carry insurance that would cover missapropriation of a persons image. So it shouldn't be comming out of excalibers pocket unless they were stupid enough not to have insurance.
While her performances may not have proceeded the internet age, her model release may have been limited to forms of publishing that were known at the time. Sort of like the issue with the writters strike. Does someone gave model release circa 92 or so that they can post.
I wonder if all the performers whose movies proceeded the internet are owed money as well. Nina Hartley, Ron Jeremy, Randy Spears, Christy Cannon, Taija Rae, Tori Welles, I've seen all their movies available online. Now that I think of it, they could all be owed money for online sales. How can you provide a release to something that didn't exist? May not be such a frivolous suit afterall.
