I tried to send Brian a care package and it said my credit card was no good, lmao. It is good, because it is a debit card and there is some money in the bank. But of all places for me to get declined, trying to buy a prison gift basket. Now I have to worry if it is going to be charged for someone's bail money.
BTW, IMHO we can't judge Brian for what happened because WE don't know what happened. Even the newspaper reports elude to the fact that his car was not physically involved in the accident that ended up being a tragedy. And of course that famlly was horribly affected and we should care about how they are doing. Because no matter whose fault it was, it wasn't theirs, and they have to live with the terrible aftermath.
If there was proof that Brian was driving impaired or had a suspended license, or was racing, I'd be more apt to be pissed about whatever role he had in the accident, because he would have been DRIVING illegally and breaking the law
But there is nothing that we know for sure that he did wrong. So until we know all the facts, how can we convict and condemn Brian? I, simply can't.

It's illegal to provoke another motorist into an accident. You can't jam on your breaks for no good reason, other than to piss off another driver or to force them into an accident (think insurance fraud).
I believe the question is, was Brian a "proximate cause." Perhaps Mike Pornlaw can give a brief summary of Corey v. Havener in the multiple combined causes test for proximate cause.

Proximate cause is a concept more applicable to civil (negligence) cases. In criminal law, the focus will be on whether or not Brian's behavior strictly falls within the elements of the crime as set forth in the codes and interpreted by case law.
A good example of how proximate cause is not required in the criminal justice system is the felony murder rule. Think of a getaway car driver who is remains outside during a bank robbery gone bad. The robbers shoot the guard on the inside. He will be tried for murder even though he had no direct part in it and murder wasn't part of the plan.

IMO the real issues here involve disputed facts and the specifics of California law with respect to felony murder. If the trier of fact makes certain factual findings in this case that are the most unfavorable to the defendant, then the felony murder rule may apply. It will be far easier to impose a felony conviction on the driver of the vehicle that actually struck and killed the child. The facts of this case seem to be hotly disputed. It will be interesting to see what happens in court. My main sympathies are with the family of the dead child, but I withold judgment until the case is tried.
