I wonder what happened? Is the current DA actually an honest prosecutor (it does happen sometimes)? Some fatal defect on the prosecution's part in the case?

The current (and newly re-appointed) US Attorney is a career prosecutor and has been with the District of Arizona since 1972. See the link above.

I think the driving force behind this case (and the other cases, especially Max & the Harbs) has been Brent Ward and his Obscenity Prosecution Task Force, LINK, which operates out of DOJ HQ in Washington.

Incidentally, It seems ol' Brent has had some trouble staffing his task force. This Posting has been up for two years. Seems that good prosecutors don't want to be a party to the shredding of the Constitution.
