Second degree in most places, as the terms apply. You usually need intent and not merely reckless disregard to get "first degree", and it probably takes a felony and not merely a misdemeanor, but it varies from state to state based on actual case law. There's also the question of whether it rises to the level of "depraved indifference", and whether they can prove Brian did anything other than tap his brake lights.

Be that as it may, the difference between manslaughter and murder is how much time he gets to contemplate anger management in the Big House...
