Actually, VJ, it's preetty clear. CC 187 says murder is the unlawful killing of another human with malice aforethought. CC 188 says malice can be implied, "When no considerable provocation appears." Vehicles are considered "destructive devices." So if you're road-raging with another guy, you're already committing one crime. If you kill somebody while commiting another crime, you've committed first degree murder.
