SALEM — A Marion County judge is backing former State Rep. Kelley Wirth, who contested a restraining order filed by her alleged former lover, Fernando Mendez.

Judge Bob Cannon said Tuesday that Mendez “has failed to carry the burden of proof’’ that Wirth represents a danger to him. Wirth declined comment afterward.

The session was the first time in open court that Wirth and Mendez described their versions of the events leading to the Sept. 6 crash by Mendez’s live-in girlfriend, Lisa Temple, that injured Wirth. However they provided few new details.


Temple has accused Wirth of having a sexual relationship with Mendez, which Wirth has denied.

The crash outside the Capitol triggered a police search of Wirth’s car that led to Wirth’s arrest on a charge of possessing methamphetamine. The Corvallis Democrat has pleaded innocent but resigned from the Oregon House in November.

Wirth said she will be unable to walk on her own for at least a year. Temple remains in jail on charges of assault and attempted murder.

Mendez quit his job as a Capitol janitor as part of a settlement that gave him $27,500 plus accrued pay in exchange for not suing the state over claims of harassment or creating a hostile work environment.

Mendez said he disclosed his prior relationship with Wirth to Temple on Sept. 4, “but the rage went to another level when Kelley came out to the house and demanded to talk to me’’ Sept. 6, he said.

When Wirth was entering her car outside the Capitol about 6:30 p.m., she heard a roar “and I thought it was the train. ... I saw Lisa Temple barreling toward me in her Thunderbird,’’ Wirth said.

Catherine Tosswill, a Portland lawyer representing Wirth, said the restraining order was part of a campaign by Temple to discredit Wirth.

Mendez said that on Oct. 20 he was leaving his home with his 2-year-old daughter when a white pickup blocked his exit.

Mendez said Wirth was inside with her two daughters, “and she said to get out of the car and talk to her.’’

Mendez said he rolled up the car windows and locked the doors until the truck left.

Asked whether he feared for his safety, he replied: “Not particularly mine, but my daughter’s.’’
