James, you gave me shit in the other thread that no one cares about FSC...yet your bring up Max's lawyer for doing such a shitty job...

The same Jeffrey Douglas who's Max's defense lawyer and did not put the kibosh on this appearance (if you feel it was so detrimental) is also Board Chair of Free Speech Coalition. A number of people in the past have commented that these interests conflict quite a bit, not always for the better, or that FSC business gets clouded up whenever Max is in the news.

There's one difference between Flynt and Max; Flynt never gave up and (not until rather recently) rarely gave into plea bargains. Flynt's most sizable legal victories were because he always felt right and would rather spend a million bucks in legal fees than pay a judgment a fraction of that; Flynt v. Falwell could have been settled ten different times in lower courts (and saved millions in legal fees for him) but it would have never reached the Supreme and been the monumental judgment it was.

Max didn't get off scott free in Los Angeles in 2004; after the jury split in 2002 he settled to pay a fine and not distribute said titles in California for three years (which was similar to what JM had accepted previously for similar charges, right?) Flynt would have never settled for that and would have fought that up the courts for certain. Max settled though and missed an opportunity for an obscenity case to go up the legal system if he had exhibited Flynt's stubbornness and maybe have a stronger legal precedent going into the current shit storm given it originated out of liberal old California and not po-dunk North Florida like today. Remember, the Miller case which has defined all this legal obscenity bullshit came right out of Newport Beach, California back in the early 70s (my home town out of coincidence); Max could have attempted that same hat trick thirty years later.

There's a billion variables in Max's case right now; I wouldn't be at all surprised if still being debated prior to the next Presidential election...of 2012.
