Hell, with any jury in the Northern District of Florida he'll lose. No question. They could get twelve blind child molesters and he'd still lose. Juries run with their emotions, plain and simple.

But I never said Max could win at trial.

Where Max can win is at the appellate level, IF a less theologically based DOJ were to be ensconced by the time the case makes it's way to the 11th Circuit. That's where you definately could see an amicable deal worked out. Because in the scheme of things, I don't see Max, or Obscenity in general, being so high on Clinton DOJ's list of priorities tht they'ed want to fight it all the way to the Supreme Court. And you know Max would.

So, again, the best thing for Max's lawyers to do, besides muzzling him, is to delay trial as long as they can, thus pushing the appellate rounds into the next administration.
