Porn Valley- Sandy Bunz,
www.sandybunz.com, says he's had the owner of WantedList.com, Ahn Tran, in smalls claims court on three occasions since January of 2006 trying to collect money. According to Bunz, $2,000 is involved and now a lot more because Bunz has lost his American Express merchant account because of the situation.
According to Bunz, Tran ordered $2,000 worth of product at the AEE 2006 convention.
"We delivered the product after which time we charged his credit card," states Bunz.
"We moved from Chatsworth to Granada Hills and he cancelled the credit card payment to American Express denying he ever got the product. After he denied that he ever got the product, American Express sent me a questionnaire to my old address and I never got it. Then in July of last year I was notified by American Express that I owed them $2,000. After I inquired with American Express, they said that that payment had been denied because they [Wanted List] never ordered the product or something like that. At that time I tried contacting Ahn Tran and he kept avoiding my calls, avoiding my calls.
"Then American Express sent a collection agency after me to pay the $2,000," Bunz continues. "I paid them back the $2,000 and I took Ahn Tran to small claims court."
It's now been three times but Bunz says the judges keep knocking him out on various technicalities before he can present the evidence.
"That's kept us from delivering the evidence to the judge," claims Bunz. "And Ahn Tran continually denies that he ever ordered the stuff at the show. My rebuttal to that is if he didn't order it, how did I get his American Express number? We delivered the product and the exact same product is now on his website. And he's claiming he got the product from some other means."
Bunz says he has the signature of one of Tran's employees on an invoice when the goods were delivered.
According to Bunz on all three occasions in small claims, Tran showed up.
"And I have a witness- an employee of mine was at the show and witnessed that he [Tran] was purchasing off another employee that I had at the time, Ken Diamond. He did the sales to Ahn Tran."
The last time Bunz was in small claims was last Wednesday. And as the case stands, Bunz will probably be back in court in November.
"This wouldn't have been so bad if I had just lost the $2,000," says Bunz. "But now all my customers that have American Express, I've had to arrange for them to pay another way."
