Cabinet appointments do require the "advice and consent of the Senate." But sometimes things happen:

Sometimes the Senate figures that if they don't appoint this guy, the next one the President sends us will only be worse. Sometimes they acquiesse on a low-level cabment member (like Education Secretary) in order to preserve more clout in denying a more important appointment (Like State, Defense, Treasury or Justice.) Sometimes they'll give the guy the benefit of the doubt if he's been a member of the Senate, like Brownback.

Of course, this assumes that the Dems will still control the Senate after the 2008 nelections. They have a one-vote majority, and anything can happen in this game of whores.
