ATLANTA, Georgia (CNN) -- A judge on Monday threw out the 10-year sentence against a 21-year-old for a consensual sex encounter he had as a teenager. But the state attorney general quickly filed a notice of appeal, keeping Genarlow Wilson in prison for the time being.
The prosecutor's move brought an abrupt halt to the jubilation Wilson's mother, Juannessa Bennett, and his attorney, B.J. Bernstein, were feeling, and the plans they were making for Bennett to be reunited with her son.
"It is extremely, extremely disturbing that the attorney general would take this action now," Bernstein said, adding that she did not know what message "he's trying to send" or "who he's representing."
In a written statement, Georgia Attorney General Thurbert Baker said he filed the appeal to resolve "clearly erroneous legal issues," saying that while the judge did have the authority to grant habeas relief, he did not have the authority "to reduce or modify the judgment of the trial court."
Separately, Baker noted that Douglas County recently had offered a plea deal "that would have allowed Genarlow Wilson to plead to First Offender Treatment, which would mean that he would not have a criminal record nor would he be subject to registering on the sex offender registry once his sentence had been completed."
"The plea deal, if accepted by Genarlow Wilson's lawyers, could also result in Genarlow Wilson receiving a sentence substantially shorter than the 10-year mandatory minimum sentence for which he was originally sentenced, possibly leading to his release based upon time already served," Baker wrote.
"Genarlow Wilson, through his attorneys, rejected all of those offers. The district attorney's office has indicated that the plea offer will remain available to Genarlow Wilson notwithstanding the appeals process," according to Baker's statement.
Wilson has drawn support from throughout the country, including the editorial board of the New York Times and former President Jimmy Carter.
When he was 17 years old, he had a consensual sexual encounter with a 15-year-old girl, which was consensually videotaped.
Georgia law at the time made such an action a felony punishable by 10 years in prison and listing on the sex offender registry.
The state legislature later changed the law, partly in response to Wilson's case. But the change was not made retroactive, leaving Wilson in jail. He has already served more than two years.
Superior Court Judge Thomas H. Wilson of Monroe County, Georgia, voided the sentence Monday, agreeing with Bernstein that the punishment was cruel and unusual, and therefore unconstitutional, Bernstein said.
The judge ruled Wilson should serve one year, less than he has already served, and that he would not be listed as a sex offender.
Upon reading his ruling, which was faxed to her office in Atlanta, Bernstein cheered, screamed with delight, and hugged Wilson's mother. Watch Wilson's mom, lawyer's tearful reaction to the judge's ruling
"I just feel like a miracle happened," Bennett told CNN.
"He didn't deserve to have the sexual predator status," she said.
When Bernstein -- a frequent guest on CNN -- spoke to reporters before the attorney general's announcement, she pleaded with prosecutors to give up the fight.
"This has been a really long 28 months," Bernstein said tearfully. "It's a very long fight. And right now we have an order of release. And I beg the attorney general of the state of Georgia: please, enough. Do not file an appeal, please. Because we have an order of release right now for a young man that I think most everybody in the community believes should not be in prison."
She added, "Please, please, enough."
Bennett called the decision "a dream come true. It's definitely a dream come true." Of the judge she said, "He got a lot of heart, and God bless him."
Bernstein said she could not believe how long it took to get to this point.

If the legislature already changed the sentancing law, then why appeal? He will be the only person to ever serve that long.

Because the new law is not retroactive, so it doesn't apply to him. Only in a backwards assed state like Georgia would a case inspire a change in legislation and yet not apply to the case itself.
On the other hand, he's got a Great case for Habeus Corpus relief. Ten Years? Sounds like a classic violation of this Defendant's Eighth and Fourteenth Amendment Rights.

From what I just quickly Googled:
1) Sixteen is the age of consent in Georgia;
2) Per Georgia Code 16-6-3 (a): A person commits the offense of statutory rape when he or she engages in sexual intercourse with any person under the age of 16 years and not his or her spouse, provided that no conviction shall be had for this offense on the unsupported testimony of the victim.
Per Georgia Code 16-6-3 (b): A person convicted of the offense of statutory rape shall be punished by imprisonment for not less than one nor more than 20 years; provided, however, that if the person so convicted is 21 years of age or older, such person shall be punished by imprisonment for not less than ten nor more than 20 years; provided, further, that if the victim is 14 or 15 years of age and the person so convicted is no more than three years older than the victim, such person shall be guilty of a misdemeanor.
Now I have no way of knowing whether or not thatt's the old law or the new law. (It's from a legal forum, posted 5/22/06.) But according to this, since the Boy was 17 and the Girl was 15, this should have been tried as a Misdemeanor. No Misdemeanor, even in Stalin's Gulags, ever carried a ten year sentence. Unless making the video had something to do with it.

That is correct. And 17 year olds here at home. In Mississippi, it's 16, UNLESS, she's already lost her virginity between the ages of 12 and 16. Then she's free and clear.

Now see, it's legal if they're already in Mississippi or Georgia or wherever, and you bang them there. But if you take them across State Lines, the Mann Act kicks in and then you're looking at Federal time. So if you take the RV and go from State to State, sampling the local talent, you're in the clear. Just don't take your teeny bopper across State Lines.

Yeah, but what if circumstances (financial, legal, etc.) prevent you from Traveling abroad? Or you want a whore that speaks English (or a resonable facimilie thereof?) Mississippi is the place to go. Plus, there's gambling, or there was before Katrina hit all the Riverboats.

I saw that a while ago, General. Fortunately for Mr. Wilson, Gonzales and DOJ would have nothing to do with it. Habes initiate in the local district court (usually after State remedies have been exhausted) and are between the Inmate and the Warden of the Correctional Facility involved. Thus the case would be captioned Wilson v. (Warden) and would proceed from there to the United States Court of Appeals for the Eleventh Circuit and on to the US Supreme Court (should they choose to accept the case.) The DOJ and the US Attorney for the Northern District do not get involved.
In New York, the 62 District Attorneys have an agreement with the State Department of Correctional Services to Argue Habes on their behalf when a Petitioner is one of their particular defendants. I'm not sure how Georgia works it but I believe the State Attorney General's Office Argues Habes in their jurisdiction.
I've argued Habes on both sides, in the Southern District of NY and in the Second Circuit, and I've honestly never seen one that had merit. (Not that I'm paid to worry about merit.) This case HAS merit, from everything I've read of it, and would be a dream case to argue. Not exactly Clarence Darrow going South to argue for the Scottsboro boys, but a nice Constitutional Case nonetheless.
