Depending upon how much discretion the Sherriff is permitted under California Law and Constitution, the Judge will probably issue a Writ of Mandamus, which is a Judicial Order requiring a Public Official to perform a ministerial act. Basically, it's a way for the Judge to tell the Sherriff "Do your Fucking Job." I have no Idea, however, what the law in California is with regard to a Sherriff's ability to commutte a sentence to home confinement based upon a few tummyaches.
Ok, gotcha. I would just assume that if a judge hands out a sentence, no one could overturn it. That's pretty fucked up man.
