From telegraph.co.uk A 17-year-old college student is taking legal action against a pornographic film company after it "stole" a photograph of her and used it on the front cover of one of its productions. The snap of Lara Coton - taken on a family holiday when she was just 14 - was being used by American adult entertainment firm TVX Films for Body Magic. Last year Lara e-mailed the picture to an art website, which displays work from photography students across the UK. Her mother, Christine, had taken the photograph inside their hotel room in Blackpool in 2004. She captured her daughter wearing a black top hat and black dress. advertisement Much to the teenager's disgust, she found the photograph on the front of the American porn film earlier this year after a friend tipped her off. Lara, of Tamworth, Staffs: said: "I was horrified when I found out it was being used to sell a porn film.'' She wants compensation for her image being used without consent. TVX Films claims it was entitled to use the picture because Lara had put it in the ''public domain'' but has agreed to change the cover.

Thanks, VOD. I think there might be some foul play afoot with somebody's version of event. That girl sure as hell doesn't look 14; at first glance I thought I was looking at the cover of a Swedish Erotica tape.

it appears this happened in the UK...their laws might differ from ours...if this happened in the US, the company would be DONE and multiple people would serve time for sure

When someone tells you that there's a 14 year old girl on the cover of your porn its a very bad idea to tell her to go fuck herself. This should never have been allowed to become public. If a mistake was made look into it like your life depends on it and compensate her if its true.
Brandon- I'm not sure the mere presence of a child on a porn DVD would be child porn unless the child was actually engaged in sexual activity. But I don't know any more about it than any of you.

Yes you would need a 2257...you cant even "pretend" a girl is underage, even if she is really 18+. Max has tried this before...more than once, and has been charged for it. As a matter of fact, this is true even in mainstream movies now...although it hasnt always been so...but they have changed the laws so that even in mainstream movies an actor cant portray someone under 18 and show nudity, even if said actor is really over 18.

I doubt a criminal case can be made of it, but she's got a hell of a payout coming if she finds the right lawyer.

She's instructed an attorney out of Florida to look in to things. I emailed her to see if any of our legal eagles could help. And it was a totally altruistic act on my part.  I didn't even ask if she still had the outfit or anything.

Oops - I confused this story with another I read yesterday, and waited a few hours to type the reply. Nevermind... PS. I still wouldn't be shocked if it turns out to be a sleazy photog who padding his stock photos, but far more likely TVX just saved money grabbing a freebie off the Internet sans release. No telling where they found it... I don't see the original article on Telegraph, but Handful posted Quote:

If TVX actually has a model release from having bought that photo, then they have a shot of surviving unless the release she sent the art website was unusually narrow. Most such sites use as broad a release as possible to protect themselves.
There's a lot of sleaze at the bottom of the photo market. Corbis and Getty are expensive - that pic alone from either would likely cost more than the entire production budget of this release - but it saves you from this kind of fiasco.
