The Sweet case was dismissed on the basis that the material confiscated was not radically different from other material widely available to Canadian consumers, and as a result the Judge was satisfied that "Canadians, for better or worse, tolerate other Canadians viewing sexually explicit activity coupled with graphic violence..."
