When someone is technically "in custody", your Miranda rights have to be read to you. Or on the contrary, you can be detained for questioning.





You might want to check on your state laws on this one. Here a traffic ticket is the same as a misdemeanor warrant, meaning your ass can be hauled off to jail being only charged with a parking violation. Subsequently your vehicle will be inventoried before being towed. So any evidence found can, and will be, added to the original charge. You also can be detained for investigation for, up to 72 hours without being charged.
