there are already laws on the books regarding exposure to "blood or bodily fluid.. if you work in a hospital and accidently come in contact with someones blood you have to do incedents reports and all sorts ofthings to document the "accident".
most people say that performers are independant contracors and therefore are not subject to the same laws as employees... this notion is misguided.... the person who hires the "contractor" is the one who supplies the "workplace"(that is the "set"). as the entity that is in control of the workplace they have an obligation to make sure that no one in that workplace is exposed to any dangerous situation....just like a customer in a department store who gets hit in the head by something falling off a shelf, the "controlling" entity of that workplace is responsible.... the government does not need to pass any new regulations for porn...all they need to do is enforce the existing laws...why porn sets are not regulated like any other workplace i dont know....but if you are exposing others to potentially harmful bodily fluids as a normal course of work then you can be held accountable....what is going to happen when some performer one day decides to sue a production company for exposing them to blood borne pathogens...i think that would be an interesting case. aint america great...... rock on
