Every time I lick "Agree" to a license on Microsoft software there is a gross imbalance of negotiating power and I've seen no hints any court is going to act on it any time soon.

I've never heard of any one contracting a sexually transmitted disease from Microsoft products, never heard of them killing themselves, no pro lapsed rectums either, no drug addicition. Courts have done nothing because no whore has the resources to hire a lawyer equipped to handle these types of entertainment law questons. Why would the RIAA get involved? Mainstream performers already have marketing rights and residuals to their work, some even get a cut of the gross.
